These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and CyberSouth LLC, a Mississippi limited liability company ("CyberSouth," "we," "us," or "our"), governing your use of the CyberSouth Compass mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Age Requirement

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age and that you have the legal capacity to enter into these Terms. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License

CyberSouth grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, subject to the Apple Media Services Terms and Conditions and these Terms.

3. Acceptable Use

CyberSouth Compass is provided as a personal network security and diagnostic tool. You agree to use the App only against networks, systems, devices, and domains that you own or for which you have explicit written authorization to test.

You agree NOT to use the App to:

Scan, probe, monitor, or test networks, systems, or devices you do not own or have explicit permission to test

Conduct unauthorized security testing, penetration testing, or vulnerability research against third parties

Attempt to gain unauthorized access to any system, network, or data

Violate any local, state, federal, or international law, including computer crime laws (such as the U.S. Computer Fraud and Abuse Act)

Disrupt, overload, or interfere with any network, server, or service

Reverse engineer, decompile, or attempt to extract source code from the App, except as permitted by applicable law

Resell, redistribute, or sublicense the App or its content

You are solely responsible for ensuring that your use of the App complies with all applicable laws and regulations in your jurisdiction.

4. No Professional Advice

The App does not provide professional cybersecurity, legal, compliance, or risk management advice. Information and tools provided through the App are for informational and personal diagnostic purposes only and are not a substitute for advice from a qualified cybersecurity professional, attorney, or other licensed advisor. You should not act or refrain from acting on the basis of information provided in the App without first seeking appropriate professional advice.

5. Subscriptions

The App offers optional Pro subscriptions purchased through Apple's In-App Purchase system:

Monthly Pro: $3.99 USD per month

Yearly Pro: $24.99 USD per year

Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Managing Your Subscription: You can manage and cancel your subscription at any time through your Apple ID account settings (Settings → [Your Name] → Subscriptions on iOS). Deleting the App does not cancel your subscription.

Free Content: The News tab and basic Compass scan are available without a subscription. Pro features include the full threat intelligence dashboard, Ransomware tracker, Breaches, CVE database, EOL tracker, Rogue AP detection, and other advanced tools.

6. Refunds

All purchases are processed by Apple. Refund requests are governed by Apple's standard refund policy and must be submitted directly to Apple at https://reportaproblem.apple.com. CyberSouth does not process refunds directly.

7. Service Availability

We may modify, suspend, or discontinue any feature of the App, in whole or in part, at any time and without liability. We do not guarantee that the App or any specific feature will always be available, uninterrupted, or error-free. Threat intelligence sources, network tools, and Pro features may change as third-party services evolve or as we improve the App.

8. Threat Intelligence Disclaimer

The App displays threat intelligence data sourced from public third-party services (including NIST NVD, HaveIBeenPwned, Ransomware.live, EPSS, endoflife.date, and various cybersecurity news sources). This information is provided "as-is" for informational purposes only.

CyberSouth does not guarantee the accuracy, completeness, timeliness, or reliability of any threat intelligence data displayed in the App. You should not rely on this information as the sole basis for any security decision. Always verify information with primary sources before taking action.

9. Network Tool Disclaimer

Network diagnostic tools provided in the App (including but not limited to port scanning, traceroute, DNS lookups, and device discovery) are provided for legitimate diagnostic and security testing purposes against networks you own or are authorized to test.

CyberSouth is not responsible for any misuse of these tools. You bear sole responsibility for the legality and consequences of your use of these tools. Unauthorized scanning of networks may violate computer crime laws and result in civil or criminal liability.

10. Export Controls and Sanctions

You may not use, export, or re-export the App in violation of United States export control laws or any other applicable laws and regulations. You represent and warrant that you are not located in, under the control of, or a national or resident of any country or region that is subject to a United States government embargo or that has been designated by the United States government as a "terrorist supporting" country, and that you are not listed on any United States government list of prohibited or restricted parties.

11. No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. CYBERSOUTH DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CYBERSOUTH LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP, EVEN IF CYBERSOUTH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

CYBERSOUTH'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO CYBERSOUTH (THROUGH APPLE) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless CyberSouth LLC and its members, officers, employees, and affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) any unauthorized scanning or testing you conduct using the App.

14. Intellectual Property

The App, including its design, source code, graphics, logos, and content (excluding third-party threat intelligence data), is the property of CyberSouth LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any ownership rights.

15. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your license to use the App ends immediately. Sections 4, 7–14, and 16–18 survive termination.

16. Changes to Terms

We may modify these Terms from time to time. Material changes will be communicated through an in-app notice or update notes. Your continued use of the App after changes take effect constitutes acceptance of the modified Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Mississippi, United States, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the App shall be resolved exclusively in the state or federal courts located in Mississippi, and you consent to the personal jurisdiction of those courts.

18. Apple-Specific Terms

You acknowledge that these Terms are between you and CyberSouth LLC, not with Apple Inc. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you.
